Frequently Asked Questions

What you need to know about family mediation

Yes. Mediation is a confidential process, and discussions generally cannot be used in later court proceedings. Limited exceptions apply under Virginia law, including concerns about child abuse or threats of harm.

Package and hourly fees are for the mediation as a whole, not per person. Most couples split the cost evenly, but you are free to agree on a different arrangement.

Attorneys are not required to attend mediation. We strongly encourage each party to consult their own attorney before signing anything, and the Memorandum of Understanding is designed to be reviewed by counsel and converted into a final agreement.

Yes. Mediation is well suited to custody, parenting time, child and spousal support, and property division. Child support discussions are guided by the Virginia support guidelines so that agreements are realistic and workable.

Every family matter begins with a confidential screening. If there are safety concerns, coercion, or a significant power imbalance, mediation may not be appropriate, and we will discuss other options or safeguards such as separate sessions.

Most couples complete Full Family Mediation in three to six weeks, depending on scheduling and how quickly financial information is gathered. Complex matters may take longer.

You keep all of your legal options. Even partial agreements — for example, on a parenting schedule — can reduce the time and cost of any remaining court process.

Mediation Disclaimer

Olive Branch Mediation provides private mediation and conflict resolution services only. Mediation is a voluntary, confidential process designed to help family members communicate more effectively and work toward mutually acceptable resolutions.

Olive Branch Mediation does not provide legal, financial, tax, medical, or therapeutic advice or services. We do not represent any party, do not advocate for any individual, and do not make decisions on behalf of participants.

Participation in mediation does not create an attorney-client relationship or any fiduciary relationship. Any agreements reached during mediation are party-driven and are recorded in a Memorandum of Understanding, which participants are encouraged to have reviewed by their own independent legal counsel before it is finalized or submitted to a court.

Mediation is not a substitute for legal representation or court proceedings. Mediation may not be appropriate where there is a history of domestic abuse, coercion, or safety concerns; all family matters are screened at intake. Outcomes depend on the voluntary participation and good-faith efforts of all parties involved.
