Is mediation confidential?

Yes. Everything discussed during mediation is strictly confidential. Our sessions are a protected space — nothing shared during the process can be used in subsequent legal proceedings without the consent of all parties.

Do both parties need to agree to mediate?

Mediation is a voluntary process, so yes — both parties need to be willing to participate. If the other party is hesitant, we're happy to discuss how to approach that conversation.

Do I need a lawyer to participate in mediation?

You do not need an attorney to participate in mediation, though we always encourage parties to seek independent legal counsel before, during, or after the process. Attorneys may attend sessions with prior agreement from all parties.

How long does the mediation process take?

It varies based on the complexity of the dispute. A single-issue matter may resolve in one or two sessions, while more complex commercial or employment disputes may require three or more sessions over several weeks.

Are sessions available virtually?

Yes. We offer both virtual sessions via video conference and in-person sessions in Virginia. Many clients prefer virtual sessions for convenience and flexibility.
