What you need to know about elder mediation
Anyone with a meaningful role in the decision — the older adult, spouses, adult children, siblings, caregivers, and sometimes a care manager or fiduciary. We help the family decide who should be involved.
Whenever possible, the older adult's voice is central to the process. Participation is adapted to their health, capacity, and wishes — in person, by phone, through a support person, or through a separate conversation.
Yes. Mediation is a confidential process. Limited exceptions apply under Virginia law, including concerns about abuse, neglect, or exploitation of a vulnerable adult.
Mediation can help families reach agreement on guardianship, powers of attorney, care costs, and inheritance disagreements. Any agreement involving legal documents or a court filing should be reviewed by each family member's own attorney.
Families decide. Costs are often shared among siblings or paid from the older adult's funds with appropriate authority. Fees are per session or package, not per family member.
A Family Care Conversation is usually scheduled within one to two weeks. A Family Care Plan typically takes two to four weeks, depending on how many family members are involved and their availability.
Mediation Disclaimer
Olive Branch Mediation provides private mediation and conflict resolution services only. Mediation is a voluntary, confidential process designed to help family members communicate more effectively and work toward mutually acceptable resolutions.
Olive Branch Mediation does not provide legal, financial, tax, medical, or therapeutic advice or services. We do not represent any party, do not advocate for any individual, and do not make decisions on behalf of participants.
Participation in mediation does not create an attorney-client relationship or any fiduciary relationship. Any agreements reached during mediation are party-driven and are recorded in a Memorandum of Understanding, which participants are encouraged to have reviewed by their own independent legal counsel before it is finalized or submitted to a court.
Mediation is not a substitute for legal representation or court proceedings. Mediation may not be appropriate where there is a history of domestic abuse, coercion, or safety concerns; all family matters are screened at intake. Outcomes depend on the voluntary participation and good-faith efforts of all parties involved.
